Terms of Service

1. Introduction and Acceptance of Terms

These Terms of Service (“Terms”) govern your access to and use of the services, programs, website, facilities, communications, and related offerings provided by Maple Ridge Learning Academy (“Maple Ridge,” “we,” “us,” or “our”), a school located at 2450 Yonge Street, Toronto, ON M4P 2H5, Canada.

By enrolling in, registering for, purchasing, or otherwise using our services, or by permitting a child or dependent to participate in our programs, you acknowledge that you have read, understood, and agree to be bound by these Terms. If you do not agree, you must not use our services.

If you are accepting these Terms on behalf of a child, student, or another person, you represent and warrant that you are the parent, legal guardian, or authorized representative with authority to do so.

2. Scope of Services

Maple Ridge provides educational and enrichment services, which may include, without limitation:

  • Early childhood education;
  • Elementary academic programs;
  • After-school tutoring;
  • Homework support and study skills coaching;
  • Language and literacy development; and
  • STEM enrichment activities.

Services may be delivered in person, online, or through a hybrid format, depending on the program. Specific schedules, age ranges, class sizes, curriculum outlines, staffing, and program availability may vary and are subject to change.

We reserve the right to modify, suspend, or discontinue any service, program, or activity at any time, subject to applicable law and any written agreement otherwise provided to you.

3. User Obligations and Responsibilities

By using our services, you agree to the following obligations:

  • Provide accurate, current, and complete information during registration and at all times thereafter;
  • Promptly update us regarding any changes to contact information, emergency contacts, medical conditions, allergies, custody arrangements, or other information relevant to participation;
  • Ensure that the student attends sessions on time and follows all applicable rules, policies, and instructions of Maple Ridge staff;
  • Ensure that the student behaves respectfully toward staff, instructors, other students, and property;
  • Not bring prohibited items, including unsafe, illegal, or disruptive materials, to our premises or programs;
  • Comply with all health, safety, attendance, pickup/drop-off, and conduct policies communicated by Maple Ridge;
  • Supervise minors as required by program rules, including during arrival, departure, and any off-site activities where parental supervision is required;
  • Use our services only for lawful purposes and in accordance with these Terms.

You are responsible for ensuring that any child or dependent under your care complies with these Terms. Maple Ridge may suspend or terminate participation if a student or parent/guardian engages in unsafe, abusive, disruptive, fraudulent, or otherwise inappropriate conduct.

You acknowledge that educational progress depends on many factors, including attendance, effort, and individual learning needs. Maple Ridge does not guarantee specific academic outcomes, grades, test scores, or admissions results.

4. Payment Terms and Conditions

Fees for programs, registration, materials, assessments, tutoring, enrichment activities, or other services will be disclosed at the time of enrollment or in a separate fee schedule. All fees are stated in Canadian dollars unless otherwise indicated.

  • Payment is due according to the schedule provided at registration, invoice, or written agreement.
  • We may require deposits, advance payments, or recurring billing for certain services.
  • Late or missed payments may result in suspension of services, refusal of continued enrollment, or collection action, subject to applicable law.
  • You are responsible for any applicable taxes, unless expressly stated otherwise.
  • Returned payments, chargebacks, or failed transactions may be subject to administrative fees to the extent permitted by law.

Unless otherwise required by law or expressly stated in writing, fees are non-transferable and may be non-refundable. Promotional pricing, discounts, and scholarships, if offered, may be subject to additional conditions and may be withdrawn at any time.

5. Cancellation and Refund Policy

Cancellation and refund terms may vary depending on the service, program length, and enrollment type. Any specific cancellation policy provided at registration, in an invoice, or in a written agreement will apply in addition to these Terms.

  • To cancel a service or enrollment, you must provide notice in writing to Maple Ridge at the contact information listed below.
  • Refund eligibility, if any, may depend on the timing of cancellation, the nature of the service, and whether materials, staffing, or reserved placement costs have already been incurred.
  • Missed classes, absences, late arrivals, early departures, or unused sessions are generally not refundable unless required by law or expressly approved by Maple Ridge in writing.
  • Where a refund is approved, it may be issued using the original payment method or another reasonable method selected by Maple Ridge.
  • Any non-refundable deposits, registration fees, or administrative fees will be clearly identified where applicable.

Maple Ridge may cancel, reschedule, or modify a program due to insufficient enrollment, staffing issues, safety concerns, public health requirements, or other operational reasons. In such cases, we will make reasonable efforts to provide notice and, where appropriate, a prorated credit or refund, subject to applicable law and the circumstances of the cancellation.

6. Liability Limitations

To the fullest extent permitted by applicable law, Maple Ridge, its directors, officers, employees, contractors, instructors, agents, and affiliates shall not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, including loss of profits, loss of data, loss of opportunity, or business interruption, arising out of or related to the use of our services.

To the fullest extent permitted by law, our total aggregate liability for any claim arising out of or relating to the services shall not exceed the amount paid by you to Maple Ridge for the specific service giving rise to the claim during the three (3) months preceding the event giving rise to liability, or such lesser amount as may be required by law.

Nothing in these Terms limits or excludes liability where such limitation or exclusion is prohibited by law, including liability for gross negligence, wilful misconduct, fraud, or any other liability that cannot lawfully be limited or excluded under applicable Canadian law.

You acknowledge that participation in educational, physical, enrichment, or off-site activities may involve inherent risks. To the extent permitted by law, you assume those risks on behalf of yourself and any participating minor, except to the extent caused by our negligence or breach of these Terms.

7. Intellectual Property Rights

All content, materials, lesson plans, worksheets, assessments, curricula, logos, designs, text, graphics, videos, audio, software, and other intellectual property made available by Maple Ridge are owned by or licensed to Maple Ridge and are protected by applicable copyright, trademark, and other intellectual property laws.

  • You may use our materials only for personal, non-commercial, educational use in connection with participation in our services.
  • You may not copy, reproduce, distribute, modify, publish, transmit, sell, license, or create derivative works from our materials without prior written consent.
  • You may not remove proprietary notices or use our name, logo, or branding without authorization.
  • Any feedback, suggestions, or ideas you provide may be used by Maple Ridge without compensation or obligation, unless otherwise agreed in writing.

8. Data Protection and Privacy

Maple Ridge collects, uses, discloses, and retains personal information in accordance with applicable Canadian privacy laws, including the Personal Information Protection and Electronic Documents Act (PIPEDA) and any applicable provincial privacy legislation.

We may collect personal information such as names, contact details, emergency contacts, student information, attendance records, payment information, learning needs, and other information necessary to provide and administer our services, maintain safety, communicate with families, and comply with legal obligations.

  • We use personal information only for legitimate educational, administrative, safety, billing, and communication purposes, unless otherwise permitted or required by law.
  • We may share information with service providers who assist us in operating our programs, subject to confidentiality and data protection obligations.
  • We may disclose information where required by law, court order, regulatory authority, or to protect the safety of students, staff, or others.
  • We take reasonable administrative, technical, and physical safeguards to protect personal information, but no method of transmission or storage is completely secure.

9. Force Majeure

Maple Ridge shall not be liable for any delay or failure to perform its obligations under these Terms where such delay or failure results from events beyond our reasonable control, including but not limited to natural disasters, fire, flood, severe weather, power outages, labour disputes, epidemics, pandemics, public health emergencies, government orders, war, terrorism, civil unrest, transportation disruptions, internet or telecommunications failures, or acts of third parties.

In such circumstances, we may suspend, modify, or reschedule services as reasonably necessary. We will make reasonable efforts to notify affected families and provide alternative arrangements where practicable.

10. Changes to Terms

We may update or revise these Terms from time to time to reflect changes in our services, legal requirements, operational practices, or other business needs. The updated Terms will be posted or otherwise communicated with a revised effective date.

Your continued use of our services after the effective date of any revised Terms constitutes acceptance of the updated Terms. If you do not agree to the revised Terms, you must discontinue use of the services and, where applicable, cancel enrollment in accordance with the cancellation policy.

11. Applicable Law and Jurisdiction

These Terms and any dispute, claim, or controversy arising out of or relating to them, the services, or your use of Maple Ridge’s offerings shall be governed by and construed in accordance with the laws of the Province of Ontario and the federal laws of Canada applicable therein, without regard to conflict of law principles.

Subject to any mandatory consumer protection or other applicable legal rights, you agree that the courts located in Toronto, Ontario shall have exclusive jurisdiction over any dispute arising from or relating to these Terms or the services.

13. Severability Clause

If any provision of these Terms is found to be invalid, illegal, or unenforceable by a court of competent jurisdiction, that provision shall be severed to the minimum extent necessary, and the remaining provisions shall continue in full force and effect.

If any invalid or unenforceable provision can be modified to make it valid and enforceable, it shall be interpreted and enforced to the maximum extent permitted by law in a manner that most closely reflects the original intent of the parties.

By using Maple Ridge Learning Academy’s services, you acknowledge that you have read and understood these Terms and agree to be bound by them.
